How to Calculate Severance Pay / Cómo Calcular la Liquidación

Whether you call it Liquidación (Venezuela, Colombia, Ecuador), Finiquito (México, Chile), Cesantías (Colombia), Indemnización (Argentina, Perú), or Beneficios Sociales (Bolivia) — severance pay represents your earned rights upon leaving employment. It is the money an employer is legally obligated to pay a worker when their contract ends.

The formula varies by country, but most Latin American labor laws share common components:

Years of Service

The base of every severance formula is your antigüedad — years (and months) of continuous service. Most countries require a minimum period (usually 3–6 months) to qualify. Venezuela's LOTTT calculates 30 days of salary per year, while Colombia calculates 1 full month per year.

Justified vs. Unjust Dismissal

A despido injustificado (unjust dismissal) triggers additional indemnity payments — often double the standard severance. Mexico's LFT awards 3 months' salary + 20 days/year. Venezuela's LOTTT adds 60 days of salario integral. Always know your dismissal type before negotiating.

Vacations & Bonuses

Your final liquidación includes vacaciones proporcionales (proportional vacation pay), prima de servicios (Colombia), aguinaldo or gratificación (México, Perú), and any other accrued benefits. These are legally mandatory — not optional employer discretion.

Your Legal Rights

In all Latin American countries, severance pay is a constitutional right, not a favour. Employers who refuse to pay face lawsuits, fines, and double-payment obligations.
