How to Calculate Severance Pay / Cómo Calcular la Liquidación

It is the money an employer is legally obligated to pay a worker when their contract ends.

The formula varies by country, but most Latin American labor laws share common components:

Years of Service

The base of every severance formula is your antigüedad — years (and months) of continuous service. Most countries require a minimum period (usually 3–6 months) to qualify. Venezuela's LOTTT calculates 30 days of salary per year, while Colombia calculates 1 full month per year.

Justified vs. Unjust Dismissal

A despido injustificado (unjust dismissal) triggers additional indemnity payments — often double the standard severance. Mexico's LFT awards 3 months' salary + 20 days/year. Venezuela's LOTTT adds 60 days of salario integral. Always know your dismissal type before negotiating.

For unjust dismissal, indemnification adds 30 days for the first year + 20 days per additional year (for workers earning up to 10 minimum wages).
These are different terms for similar concepts across Latin America: Liquidación (Venezuela, Colombia, Ecuador) is the full final settlement including all earned benefits. Finiquito (México, Chile) refers specifically to the settlement of remaining wages, vacation, and bonuses upon departure — often distinct from the additional indemnización owed in unjust dismissal. Indemnización (Argentina, Perú) focuses on the compensatory payment for dismissal without just cause. Cesantías (Colombia) is a specific savings fund — one month's salary deposited annually.
