UAE labour law gratuity rules

Federal Decree-Law No. 33 of 2021 sets how end-of-service gratuity is calculated for employees with at least one year of continuous service.

Figures here are estimates; your employer’s HR records and any special clauses in your contract determine the final payout.

1 to 5 years

21 days of basic salary per year of service.

Beyond 5 years

30 days of basic salary per year for the period after five full years.

Important notes

Gratuity uses basic salary only (no allowances). Total gratuity is capped at two years’ salary. Partial years are pro-rata; unpaid leave days are typically excluded from service.

Under the new UAE Labour Law (Decree-Law 33/2021), gratuity is calculated based on your basic salary. For the first 5 years of service, you get 21 days of basic salary per year. For any service beyond 5 years, you get 30 days of basic salary per year.
An employee must complete at least one continuous year of service to be eligible for end-of-service gratuity in the UAE.
Under the new law, the distinction between resignation and termination has been removed for limited contracts. You are entitled to your full gratuity calculation regardless of the reason for leaving, provided you have completed at least one year of service.
