Understanding Azubi Vacation Rights in Germany

Every apprentice (*Azubi*) in Germany is legally entitled to paid annual leave (*Erholungsurlaub*). The number of days is determined by the **Youth Employment Protection Act (JArbSchG)** for minors, or the **Federal Leave Act (BUrlG)** for adult apprentices.

1. Pro-Rata Partial Year Rule (Teilurlaub §5 BUrlG)

Most German apprenticeships begin on **August 1st or September 1st**. For the first partial calendar year (August to December = 5 months), your leave is calculated pro-rata: (Annual Days / 12) × Months Worked. Fractions of half a day or more ($\ge 0.5$) are legally rounded up to full days (§5 Abs. 3 BUrlG).

2. Tarifvertrag vs Legal Minimum

While the statutory minimum for adults is 20 days (for a 5-day week), the vast majority of German companies, tariff agreements (IG Metall, TVöD, IHK contracts) grant apprentices **30 paid vacation days per year**.

What happens to unused Azubi vacation days at the end of the year?

Under German law, vacation days must be taken during the current calendar year. Remaining days can only be carried over to March 31st of the following year if company operational reasons or illness prevented taking them.

Can I take vacation during Berufsschule days?

Under JArbSchG §19 Abs. 3, vacation should be taken during official school holidays. If taken during school periods, missed school days must be excused or approved by the Berufsschule.
